Standard Terms and Conditions of Sale (Sharia-Compliant)
These Terms and Conditions (“Terms”) govern all sales of goods and services (“Products”) provided by SAFAF GO LTD (“Seller”) to the client (“Buyer”). By placing an order, the Buyer agrees to these Terms, in accordance with Islamic commercial ethics (Sharia).
- Orders & Acceptance
All orders are subject to confirmation by the Seller.
Seller reserves the right to decline any order if fulfillment is not possible or lawful.
2. Prices & Payment
Prices are clearly stated at the time of order and are final once confirmed.
Payments must be made in full at the time agreed in writing.
If payment is delayed, the Seller may suspend deliveries or future sales until payment is settled.
No interest (riba) will be charged. However, the Buyer is responsible for actual costs incurred in recovering overdue payments (e.g., logistics or legal fees).
3. Delivery & Risk
Delivery dates are estimates. Seller will strive to deliver on time but will not be liable for delays beyond its control.
Ownership and responsibility for the Products pass to the Buyer upon delivery.
4. Returns & Refunds
Returns are allowed if:
The Buyer notifies Seller within 7/14 of delivery.
The Products are defective, damaged, or not as described.
Refunds or replacements will be provided fairly after inspection.
Certain items (e.g., perishable goods, custom orders) may not be returnable, except if defective.
5. Warranties
Seller guarantees that Products are as described and free from known defects at the time of delivery.
Buyer must handle, store, and use the Products properly.
No additional warranties are implied beyond what is agreed.
6. Limitation of Liability
Seller’s liability is limited to the value of the Products supplied.
Seller is not responsible for indirect losses such as lost profits or business interruptions.
7. Force Majeure
Seller is not liable for failure or delay caused by events beyond its control (e.g., natural disasters, supply chain disruptions, government restrictions).
8. Governing Law & Dispute Resolution
These Terms are governed by the principles of Islamic Sharia and applicable laws of Nigeria under Sharia-compliant jurisdictions.
Any dispute should first be resolved amicably.
If unresolved, the matter shall be referred to arbitration or a competent court applying Sharia principles.
9. Good Faith
- Both Seller and Buyer agree to act in good faith, with honesty, fairness, and transparency, as required in Islamic trade.
